Terms & Conditions
The terms that apply when you use magnihydrotech.com and when you buy products from Magni Hydrotech GmbH.
Last updated: 19 October 2026
1. Scope
These terms apply to the use of this website (magnihydrotech.com) and to all offers, quotations, deliveries and services provided by Magni Hydrotech GmbH ("we", "us"). Our products are sold to business customers only (Section 14 of the German Civil Code, BGB). Conflicting or deviating terms of the customer apply only if we have expressly agreed to them in writing.
2. Use of this website
The content of this website is provided for general information about our company and products. You may view, download and print it for your own business purposes. You may not copy, modify or republish texts, images, logos or the product brochure without our prior written consent. You agree not to misuse the site, for example by attempting to gain unauthorised access, introducing malicious code or submitting false enquiries.
3. Product information
We take care to keep the information on this site accurate and up to date, but it is not a binding offer. Performance figures — such as water savings, yield improvements or reductions in salinity and scale — are results reported from previous installations. Actual results depend on water chemistry, soil, climate, flow rate, installation and operating conditions, and are not guaranteed unless expressly agreed in writing for a specific project.
4. Quotations and contracts
Sending an enquiry through this website does not create a contract. Our quotations are non-binding unless marked as binding. A contract is concluded only when we confirm an order in writing (including by email) or deliver the goods. The written order confirmation and any agreed technical specification determine the scope of supply.
5. Prices and payment
Prices are quoted per project, in euros, ex works (EXW Incoterms® 2020) unless otherwise agreed, and exclude VAT, packaging, freight, insurance, customs duties and installation. Invoices are payable within 14 days of the invoice date without deduction unless the order confirmation states otherwise. We may require advance payment or a deposit, particularly for export orders.
6. Delivery and risk
Delivery dates are approximate unless expressly agreed as binding. Partial deliveries are permitted where reasonable. Risk passes to the customer when the goods are handed over to the carrier or made available for collection. Delays caused by force majeure or other events beyond our control extend delivery times accordingly.
7. Retention of title
Delivered goods remain our property until all claims arising from the business relationship have been paid in full.
8. Installation and inspection
Units must be installed and operated in accordance with our installation instructions and the applicable technical rules. The customer must inspect goods promptly on receipt and notify us of any visible defects in writing without undue delay, in line with Section 377 of the German Commercial Code (HGB).
9. Warranty
We warrant that our products are free from defects in material and workmanship for 12 months from delivery, unless a longer period is agreed. At our option we will repair or replace defective goods. The warranty does not cover damage caused by improper installation, operation outside the specified limits, unauthorised modification, normal wear, or external mechanical, chemical or electrical influences.
10. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for breach of an essential contractual obligation, and then only for the foreseeable damage typical of the contract. Any other liability — including for loss of profit, crop loss or indirect damage — is excluded to the extent permitted by law.
We accept no liability for the content of external websites linked from this site; their operators are solely responsible for them.
11. Intellectual property
The Magni Hydrotech name, logo, product designs, drawings and documents remain our property and are protected by copyright and other intellectual property rights. Technical documents supplied with a quotation may not be passed to third parties without our consent.
12. Privacy
We process personal data as described in our Privacy Policy.
13. Governing law and jurisdiction
These terms and all contracts with us are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes is Berlin, Germany, where the customer is a merchant, a legal entity under public law or has no general place of jurisdiction in Germany.
14. Final provisions
If any provision of these terms is or becomes invalid, the remaining provisions remain in effect. We may update these terms from time to time; the version published on this page at the time of your order applies. Questions about these terms can be sent to sales@magnihydrotech.com.
